e que se espera que entre em vigor at\u00e9 ao final deste primeiro trimestre, \u00e9 importante rever de que forma estas altera\u00e7\u00f5es impactam a nossa forma de trabalhar e o modo como gerimos as for\u00e7as de trabalho e as rela\u00e7\u00f5es que vinculamos com os nossos clientes.<\/p>\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-029deb1 CONTRATO COM TRABALHADOR ESTRANGEIRO OU AP\u00c1TRIDA<\/a>\n\t\t\t\t\t<\/div>\n\t\t\t\t\t<div id=\"elementor-tab-content-1461\" class=\"elementor-tab-content elementor-clearfix\" data-tab=\"1\" role=\"region\" aria-labelledby=\"elementor-tab-title-1461\"><ul><li><strong>Deixa de ser obrigat\u00f3ria a comunica\u00e7\u00e3o \u00e0 ACT<\/strong> da celebra\u00e7\u00e3o de contrato de trabalho com trabalhador estrangeiro ou ap\u00e1trida, antes do in\u00edcio da sua execu\u00e7\u00e3o e a respetiva cessa\u00e7\u00e3o.<\/li><\/ul><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t<div class=\"elementor-accordion-item\">\n\t\t\t\t\t<div id=\"elementor-tab-title-1462\" class=\"elementor-tab-title\" data-tab=\"2\" role=\"button\" aria-controls=\"elementor-tab-content-1462\" aria-expanded=\"false\">\n\t\t\t\t\t\t\t\t\t\t\t\t<a class=\"elementor-accordion-title\" tabindex=\"0\">II. TRABALHADOR INDEPENDENTE<\/a>\n\t\t\t\t\t<\/div>\n\t\t\t\t\t<div id=\"elementor-tab-content-1462\" class=\"elementor-tab-content elementor-clearfix\" data-tab=\"2\" role=\"region\" aria-labelledby=\"elementor-tab-title-1462\"><ul><li><strong>Considera-se em situa\u00e7\u00e3o de depend\u00eancia econ\u00f3mica o prestador pessoa singular que preste, diretamente e sem interven\u00e7\u00e3o de terceiros, atividade ao mesmo benefici\u00e1rio e dele obtenha mais de 50% do produto da sua atividade num ano civil.<\/strong> <br \/>Aplicabilidade das normas respeitantes a direitos de personalidade, igualdade e n\u00e3o discrimina\u00e7\u00e3o, seguran\u00e7a e sa\u00fade no trabalho, bem como os IRCT\u2019s aplic\u00e1veis.<\/li><\/ul><ul><li>Se o prestador de trabalho desempenhar atividade para empresas com participa\u00e7\u00f5es rec\u00edprocas, dom\u00ednio ou rela\u00e7\u00e3o de grupo, <strong>presume-se prestada a um \u00fanico benefici\u00e1rio.<\/strong><\/li><\/ul><ul><li>Prestador do trabalho pode assegurar a atividade por interm\u00e9dio de terceiro em caso de nascimento, ado\u00e7\u00e3o ou assist\u00eancia a filho ou neto, amamenta\u00e7\u00e3o e aleita\u00e7\u00e3o, interrup\u00e7\u00e3o voluntaria ou gravidez de risco pelo per\u00edodo das dispensas previstas no C\u00f3digo do Trabalho.<\/li><\/ul><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t<div class=\"elementor-accordion-item\">\n\t\t\t\t\t<div id=\"elementor-tab-title-1463\" class=\"elementor-tab-title\" data-tab=\"3\" role=\"button\" aria-controls=\"elementor-tab-content-1463\" aria-expanded=\"false\">\n\t\t\t\t\t\t\t\t\t\t\t\t<a class=\"elementor-accordion-title\" tabindex=\"0\">III. PARENTALIDADE<\/a>\n\t\t\t\t\t<\/div>\n\t\t\t\t\t<div id=\"elementor-tab-content-1463\" class=\"elementor-tab-content elementor-clearfix\" data-tab=\"3\" role=\"region\" aria-labelledby=\"elementor-tab-title-1463\"><ul><li>Criada dispensa no \u00e2mbito de processos de ado\u00e7\u00e3o e de acolhimento familiar.<\/li><\/ul><ul><li>Ap\u00f3s 120 dias consecutivos de licen\u00e7a parental passa a ser poss\u00edvel <strong>cumular os restantes dias de licen\u00e7a com trabalho a tempo parcial<\/strong><\/li><\/ul><ul><li>Licen\u00e7a parental inicial obrigat\u00f3ria do pai <strong>alargada para 28 dias, seguidos ou interpolados nos 42 dias seguintes ao nascimento, findos os quais acrescem 7 dias de licen\u00e7a desde que gozados em simult\u00e2neo com a licen\u00e7a parental inicial da m\u00e3e.<\/strong><\/li><\/ul><ul><li>Em caso de internamento hospitalar da crian\u00e7a durante o per\u00edodo ap\u00f3s o parto, a <strong>licen\u00e7a parental inicial obrigat\u00f3ria do pai suspende-se, a pedido deste, pelo per\u00edodo de dura\u00e7\u00e3o do internamento.<\/strong><\/li><\/ul><ul><li><strong>Adaptabilidade grupal e banco de horas grupal<\/strong> exclu\u00edda para:<ul><li>Trabalhador com filho menor de 3 anos, doen\u00e7a cr\u00f3nica ou defici\u00eancia, salvo concord\u00e2ncia daquele por escrito;<\/li><li>Trabalhador com filho entre os 3 e os 6 anos mediante declara\u00e7\u00e3o em como o outro progenitor exerce atividade profissional e est\u00e1 impossibilitado de prestar assist\u00eancia<\/li><\/ul><\/li><\/ul><ul><li>Em caso de a<strong>do\u00e7\u00e3o de menor de 15 anos<\/strong>, o candidato tem direito \u00e0 licen\u00e7a parental exclusiva do pai.<br \/>O candidato pode gozar at\u00e9 30 dias de licen\u00e7a parental inicial no per\u00edodo de transi\u00e7\u00e3o e acompanhamento, devendo informar o empregador, por documento, com anteced\u00eancia de 10 dias ou, em caso de urg\u00eancia assim que poss\u00edvel.<br \/><span style=\"text-decoration: underline\">Aplica-se a fam\u00edlias de acolhimento.<\/span><\/li><li>Em situa\u00e7\u00f5es de <strong>processos de ado\u00e7\u00e3o e acolhimento familiar<\/strong> o trabalhador fica dispensado de prestar trabalho para realiza\u00e7\u00e3o de avalia\u00e7\u00e3o ou para cumprimento das obriga\u00e7\u00f5es e procedimentos legais, devendo apresentar justifica\u00e7\u00e3o ao empregador.<\/li><\/ul><ul><li><strong>Criada Licen\u00e7a parental complementar<\/strong> na modalidade de trabalho a tempo parcial durante tr\u00eas meses, com um per\u00edodo normal de trabalho igual a metade do tempo completo, desde que a licen\u00e7a seja exercida na totalidade por cada um dos progenitores.<br \/>Se ambos os progenitores trabalharem para o mesmo empregador, este pode adiar o gozo da licen\u00e7a de um deles at\u00e9 ao t\u00e9rmino do per\u00edodo de gozo da licen\u00e7a do outro progenitor fundamentadamente e por escrito.<\/li><\/ul><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t<div class=\"elementor-accordion-item\">\n\t\t\t\t\t<div id=\"elementor-tab-title-1464\" class=\"elementor-tab-title\" data-tab=\"4\" role=\"button\" aria-controls=\"elementor-tab-content-1464\" aria-expanded=\"false\">\n\t\t\t\t\t\t\t\t\t\t\t\t<a class=\"elementor-accordion-title\" tabindex=\"0\">IV. DEVER DE INFORMA\u00c7\u00c3O<\/a>\n\t\t\t\t\t<\/div>\n\t\t\t\t\t<div id=\"elementor-tab-content-1464\" class=\"elementor-tab-content elementor-clearfix\" data-tab=\"4\" role=\"region\" aria-labelledby=\"elementor-tab-title-1464\"><ul><li><span style=\"text-decoration: underline\"><strong>No contrato de trabalho:<\/strong> <\/span><ul><li><strong>Termo estipulado e dura\u00e7\u00e3o previs\u00edvel, consoante se trate de contrato a termo certo ou incerto;<\/strong><\/li><li>IRCT e respetivas entidades celebrantes;<\/li><li>Fundo de garantia de compensa\u00e7\u00e3o do trabalho;<\/li><li>Identifica\u00e7\u00e3o do utilizador no caso de trabalhador tempor\u00e1rio;<\/li><li>Par\u00e2metros, crit\u00e9rios, regras e instru\u00e7\u00f5es sobre algoritmos ou sistemas de intelig\u00eancia artificial;<\/li><li>Trabalhador no estrangeiro;<\/li><li>Entre outras que se bastam com remiss\u00e3o para a lei, para o IRCT ou Regulamento interno.<\/li><\/ul><\/li><\/ul><ul><li><strong>Esta informa\u00e7\u00e3o deve ser comprovadamente prestada:<\/strong><ul><li>At\u00e9 ao 7\u00ba dia subsequente ao in\u00edcio do contrato quando prestada atrav\u00e9s de mais de um documento;<\/li><li>No prazo de um m\u00eas contado do in\u00edcio da execu\u00e7\u00e3o do contrato quanto \u00e0s demais.<\/li><\/ul><\/li><\/ul><p>Obriga\u00e7\u00e3o de disponibilizar aquela informa\u00e7\u00e3o \u00e0s entidades publicas que as solicitem.<br \/>O empregador tem ainda de informar trabalhador de eventuais altera\u00e7\u00f5es at\u00e9 \u00e0 data de produ\u00e7\u00e3o de efeitos das mesmas.<\/p><ul><li><span style=\"text-decoration: underline\"><strong>Em situa\u00e7\u00e3o de presta\u00e7\u00e3o de trabalho no estrangeiro:<\/strong><\/span><ul><li><strong>Identifica\u00e7\u00e3o do Estado onde o trabalho deve ser prestado e a dura\u00e7\u00e3o previs\u00edvel do per\u00edodo de trabalho a prestar;<\/strong><\/li><li><strong>Moeda e lugar do pagamento;<\/strong><\/li><li><strong>Possibilidade de repatriamento e condi\u00e7\u00f5es;<\/strong><\/li><li><strong>Retribui\u00e7\u00e3o a que tem direito nos termos da lei aplic\u00e1vel no Estado de acolhimento, em situa\u00e7\u00f5es de destacamento;<\/strong><\/li><li>Subs\u00eddios inerentes ao destacamento e reembolso de despesas de viagem, de alojamento e de alimenta\u00e7\u00e3o, quando aplic\u00e1vel;<\/li><li>Site do Estado de acolhimento, criado nos termos da legisla\u00e7\u00e3o espec\u00edfica aplic\u00e1vel ao destacamento.<\/li><\/ul><\/li><\/ul><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t<div class=\"elementor-accordion-item\">\n\t\t\t\t\t<div id=\"elementor-tab-title-1465\" class=\"elementor-tab-title\" data-tab=\"5\" role=\"button\" aria-controls=\"elementor-tab-content-1465\" aria-expanded=\"false\">\n\t\t\t\t\t\t\t\t\t\t\t\t<a class=\"elementor-accordion-title\" tabindex=\"0\">V. TRABALHADOR-ESTUDANTE<\/a>\n\t\t\t\t\t<\/div>\n\t\t\t\t\t<div id=\"elementor-tab-content-1465\" class=\"elementor-tab-content elementor-clearfix\" data-tab=\"5\" role=\"region\" aria-labelledby=\"elementor-tab-title-1465\"><ul><li><strong>O contrato de trabalho com estudante <span style=\"text-decoration: underline\">vigente em per\u00edodo de f\u00e9rias ou interrup\u00e7\u00e3o letiva<\/span><\/strong> n\u00e3o est\u00e1 sujeito a forma escrita. <br \/>Para tal n\u00e3o \u00e9 exig\u00edvel o estatuto de trabalhador-estudante e o contrato deve ser comunicado \u00e0 Seguran\u00e7a Social. <br \/>Tratando-se de <strong>contrato a termo resolutivo e de contrato de trabalho tempor\u00e1rio<\/strong> aplicam-se os requisitos de admissibilidade dos artigos 140.\u00ba e 180\u00ba do C\u00f3digo do Trabalho, devendo o motivo justificativo ser comunicado \u00e0 Seguran\u00e7a Social com men\u00e7\u00e3o concreta dos factos.<\/li><\/ul><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t<div class=\"elementor-accordion-item\">\n\t\t\t\t\t<div id=\"elementor-tab-title-1466\" class=\"elementor-tab-title\" data-tab=\"6\" role=\"button\" aria-controls=\"elementor-tab-content-1466\" aria-expanded=\"false\">\n\t\t\t\t\t\t\t\t\t\t\t\t<a class=\"elementor-accordion-title\" tabindex=\"0\">VI. PER\u00cdODO EXPERIMENTAL<\/a>\n\t\t\t\t\t<\/div>\n\t\t\t\t\t<div id=\"elementor-tab-content-1466\" class=\"elementor-tab-content elementor-clearfix\" data-tab=\"6\" role=\"region\" aria-labelledby=\"elementor-tab-title-1466\"><ul><li>Se o empregador n\u00e3o informar o trabalhador da dura\u00e7\u00e3o e condi\u00e7\u00f5es do per\u00edodo experimental <strong>presume-se a sua exclus\u00e3o. Assim, se nada for previsto no contrato de trabalho ou em documento anexo, entende-se que as partes pretenderam prescindir de per\u00edodo experimental.<\/strong><\/li><\/ul><ul><li>Nos casos de per\u00edodo experimental superior a 120 dias, a den\u00fancia pelo empregador deve ser realizada com pr\u00e9-aviso de 30 dias.<\/li><\/ul><ul><li>No caso <strong>contrata\u00e7\u00e3o de trabalhador \u00e0 procura de primeiro emprego e de desempregado de longa<\/strong>, a dura\u00e7\u00e3o do per\u00edodo experimental \u00e9 reduzida ou exclu\u00edda se a dura\u00e7\u00e3o de anterior contrato de trabalho a termo com empregador diferente tiver sido igual ou superior a 90 dias. <br \/><strong><span style=\"text-decoration: underline\">Passa a ser obrigat\u00f3ria a comunica\u00e7\u00e3o \u00e0 ACT<\/span>, nos 15 dias posteriores, a den\u00fancia de contrato de trabalho com trabalhador \u00e0 procura do primeiro emprego desempregado de longa dura\u00e7\u00e3o.<\/strong><\/li><\/ul><ul><li>O per\u00edodo experimental \u00e9 reduzido se a dura\u00e7\u00e3o de est\u00e1gio profissional com avalia\u00e7\u00e3o positiva na mesma atividade, mas empregador diferente, tiver sido igual ou superior a 90 dias, nos \u00faltimos 12 meses.<\/li><\/ul><ul><li>Comunica\u00e7\u00e3o \u00e0 CITE da den\u00fancia durante o per\u00edodo experimental do contrato de <span style=\"text-decoration: underline\">trabalhador cuidador.<\/span><\/li><\/ul><ul><li>Den\u00fancia em abuso de direito reconhecida judicialmente com as consequ\u00eancias do despedimento il\u00edcito.<\/li><\/ul><\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t<div class=\"elementor-accordion-item\">\n\t\t\t\t\t<div id=\"elementor-tab-title-1467\" class=\"elementor-tab-title\" data-tab=\"7\" role=\"button\" aria-controls=\"elementor-tab-content-1467\" aria-expanded=\"false\">\n\t\t\t\t\t\t\t\t\t\t\t\t<a class=\"elementor-accordion-title\" tabindex=\"0\">VII. role=\"region\" aria-labelledby=\"elementor-tab-title-14612\"><ul><li>Durante a vig\u00eancia do acordo de m\u00e9dio prazo para a melhoria dos rendimentos, dos sal\u00e1rios e da competitividade, isto \u00e9, at\u00e9 2026, <strong>ficam suspensas as obriga\u00e7\u00f5es de<\/strong>:<ul><li>Comunica\u00e7\u00e3o ao FCT e ao FGCT da admiss\u00e3o de novos trabalhadores;<\/li><li>Pagamento de entregas para o FGCT.<\/li><\/ul><\/li><\/ul><ul><li>At\u00e9 \u00e0 entrada em vigor das altera\u00e7\u00f5es aos regimes jur\u00eddicos do FCT, ficam suspensas as obriga\u00e7\u00f5es relativamente ao mesmo:<ul><li>A obriga\u00e7\u00e3o de ades\u00e3o ao FCT;<\/li><li>O dever de incluir os trabalhadores no FCT ou ME;<\/li><li>Pagamento de entregas para o FCT;<\/li><li>Possibilidade de
